PROTECTING THE INJURED FOR OVER 30 YEARS
have you or a loved one been recently injured?
When a person is injured as a result of unsafe property or building conditions, they may have a right to make a claim for their damages against the owner of the property. Premises liability cases involve accidents that occur due to negligent maintenance, or unsafe and dangerous conditions upon property owned by someone other than the accident victim. It is the responsibility of the premises, or property owner, to protect people while on their property. If a person dies, or is injured, assaulted, or in any way harmed while on the property the owner may be held liable.
Premises injuries may occur in a variety of locations, including, apartments, homes, office buildings, shopping malls, theme park, hospitals, parking structures, and schools. Common situations giving rise to accidents include uneven floor surfaces, poorly marked changes in elevation, slippery surfaces, broken sidewalks, uneven elevators, obstructions and broken steps. These accidents are particularly serious for the elderly, and hefty emergency room and hospitalization expenses can be incurred.
While there are many different types of premises liability cases, slip and fall and trip and fall are the most common. In a slip and fall scenario the victim may slip on a wet area on the floor causing injury. In a trip and fall the victim may trip over obstructions such as stairs, debris, or uneven pavement causing injury. In the event that a property owner fails to protect people on the property they may have to pay for the victims lost wages, pain and suffering, and medical expenses.
Another emerging area of litigation includes claims against hotels, shopping centers and other businesses, who have a known problem with crime on their premises, yet have failed to protect their customers. Many of these cases involve victims who have been severely injured, raped or even killed as a result of the business establishment failing to protect its customers from known dangers.
